By accessing, viewing, or using the material on this site, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you are not granted permission to use the site and should exit immediately.
WCS reserves the right to change the terms and conditions under which this site is offered. These changes are effective immediately upon posting. You are responsible for regularly reviewing these terms and conditions. Your continued use of this site constitutes your agreement to all such terms and conditions.

"WCS" means Well Control School. "IADC" means the International Association of Drilling Contractors.
Note: Courses taken to satisfy IADC WellCAP® Certification must be completed according to the IADC rules and regulations. For example, IADC has specified a time limit for completion of certain courses, including System 21. If you do not complete the course and the exam, including any re-exam, within the IADC time limit (45 days from first launch for System 21), WCS must note the course as failed. You will then have to pay again to retake the entire course from the beginning. Retakes are subject to the same time limits as the original registration.
For certain courses, including System 21 Well Control, IADC requires WCS to use Voice Recognition for e-Learning students. The Voice Recognition software will prompt you to call a toll free number. Samples will be required at one or more points during the course. You must provide the requested voice samples in order to continue with the course, failure to due so will result in a voiding of the course and forfeiture of all fees. WCS and/or the IADC, at their sole discretion, may take additional steps to verify the identity of students taking the course and exam, including but not limited to direct contact with the exam witness.

YOUR ACCOUNT
We are committed to the security of our customers' accounts and account information. However, you must also take every precaution to ensure the safety, security and integrity of your account. If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. WCS reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
The following guidelines should assist you in ensuring that your account information remains secure:
- Do not leave your account information out in an open area accessible by others, including on your computer screen.
- Do not send your User ID or Password over any e-mail system.
- Do not enter your User ID or Password into the e-Learning Service when there are others nearby who could observe you doing so.
- Do not leave your computer unattended while you are connected to the e-Learning Service.
- We recommend that you create a strong password for your e-Learning Service, by avoiding familiar names or personal information (such as date of birth or Social Security Number), using upper and lower case letters, including digits and punctuation marks. We recommend that you log out of the e-Learning Service and close your browser completely after each session.
Please observe these guidelines. Remember, you may be held liable for the unauthorized use of your User ID and/or Password.
SERVICE AVAILABILITY
The e-Learning Services hereunder are generally available seven (7) days a week. The e-Learning Services may be unavailable from time to time for scheduled maintenance. There may also be unscheduled down time, but we will work to minimize such interruptions in service. WCS is not responsible for any loss or alleged loss, including failure to complete a course within the time limits, which arise from or in connection with the unavailability of the websites or your inability to access the websites for any reason.
REFUND POLICY
If for some unforeseen reason you had technical difficulty, which could not be resolved in a timely manner by our technical staff and which have been documented*, you will receive a refund or credit for your course based on the following schedule.
- Completing 5 out of 12 or 7 out of 15 modules, and have documented the technical difficulties that WCS cannot fix in a timely manner, you will be given a 50% refund or a credit to restart the course.
- Completing 1-4 out of 12 or 1-6 out of 15 modules, and have documented the technical difficulties that WCS cannot fix in a timely manner, you will be given a full refund or a credit to restart the course.
Note: If the student starts the course and fails to complete the course for any reason whatsoever, other than documented technical difficulties, there will be no refund of any fees.
*Definition: "documented" - To support (an assertion or claim, for example) with evidence or decisive information. i.e. called technical support multiple times, follow up emails, etc.
WCS reserves the right to revise fees at anytime.

This site and all of its content are protected by copyright pursuant to U.S. and international copyright laws. You may not copy, download, publish, modify, transmit, reproduce, create new works from, distribute, sell, loan, nor in anyway exploit any of the material contained on this site in whole or in part without the express authorization of WCS.
Elements of the WCS e-Learning web site are also protected by trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. No logo, sound or image from the site may be copied or transmitted unless expressly permitted by WCS.
INDEMNIFICATION
You agree to indemnify and hold WCS, its officers, members, and employees harmless from any claims, demands, or damages, including attorney fees, asserted by any third party due to or arising out of your use of or conduct on the site.
DISCLAIMER OF WARRANTY AND LIABILITY
WCS MAKES NO REPRESENTATIONS ABOUT THE RELIABILITY, ACCURACY, SUITABILITY, OR LACK OF VIRUSES FOR THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED IN THE SITE. WCS is not responsible for any errors or failures from any malfunction of your computer or your software nor is it responsible for any electronic virus, viruses, worms, or similar software problems that you may encounter. WCS has no liability to you for any damage or other loss, direct or consequential, which you may suffer or incur due to your use of your computer or your software. WCS makes no warranty to you regarding your computer or your software, including any warranty of merchantability or fitness for a particular purpose.

Nothing contained in this Site is intended as, nor shall be construed as legal advice, guidance, or interpretation. No attorney-client relationship is established between WCS and you by your use of this site. The information provided on this site is for general educational purposes only and specific questions about any law, statute, or regulation should be directed to an attorney with expertise in the area.
JURISDICTION
WCS controls and operates this site from Houston, Harris County, Texas, United States of America. You agree that all transactions conducted through the Well Control School e-Learning website(s) (including, without limitation, Well Control School Online University, cumulatively referred to as "the Websites") are or will be consummated in Harris County, Texas. These terms and conditions are governed by and construed in accordance with the laws of the State of Texas, without reference to its choice of law rules. You and WCS agree that any claim or cause of action that arises from your access, viewing, or use of the Websites shall be brought exclusively in the state and federal district courts residing in Harris County, Texas, USA. WCS makes no representation that materials on the site are appropriate for use in other countries and access to them from countries where the content is illegal is prohibited. You are responsible for complying with applicable local laws that regulate the content of this site.
EXPORT CONTROLS
You acknowledge and agree that material contained in this site is subject to the U.S. Export Administration Laws and regulations. If any part of these terms and conditions is held to be invalid or unenforceable for any reason including, but not limited to, the warranty disclaimers and liability limitations specified above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement will remain in full force and effect.
A printed version of this agreement shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as business documents and records that are routinely generated and maintained in printed form
These terms and conditions constitute the entire agreement between you and WCS with respect to your use of the site. You acknowledge that, in providing you access to and use of the site, WCS has relied on your agreement to be legally bound by these terms and conditions.
